Don’t Drink and Boat in Florida

Hello, I’m Doug Jackson, founding attorney of the Law Firm of Douglas G. Jackson. Today, I want to talk to you about boating under the influence and how drinking while boating could land you in trouble.

Spring is here. That means, it’s time to get out on the water. What’s more invigorating than a nice cold beer while boating out on the water. Well, be careful not to be intoxicated if you’re driving the boat because when you get taken away in handcuffs, you’ll sober right up.

In Florida, just like driving under the influence can get you a DUI, boating under the influence can get you a BUI. Yes, boating under the influence is embodied in Florida Statute Section 327.35. If you are under the influence of alcohol or drugs, you may be in violation of the law. If you have a breath or blood alcohol level of 0.08, and are operating a boat, you are definitely in violation of this law. Also, if you’re under the influence of drugs while operating a boat, you are breaking the law in Florida.

Remember, when you’re having fun on the water, just like on land, have a designated driver. You don’t want to risk being arrested, or worse, hurting someone else.
